Central Administrative Tribunal (CAT), Principal Bench, New Delhi ने 20 August 2026 के Vineet Kumar vs Delhi Police मामले में एक ऐसे employee को Old Pension Scheme (OPS) का benefit देने की प्रक्रिया पूरी करने का आदेश दिया, जिसने compassionate appointment के लिए 14 November 2003 को आवेदन किया था लेकिन actual appointment और joining October 2004 में हुई थी। Post-2003 joining के कारण वह National Pension System (NPS) में चला गया था।
इस judgment की wider importance Department of Pension & Pensioners’ Welfare (DoP&PW) के 22 June 2026 Office Memorandum से जुड़ती है। Government ने compassionate appointment cases में application date को crucial date माना है, provided applicant उस समय appointment के लिए eligible था। Eligible family member ने 31 December 2003 या उससे पहले application दी हो तो concerned Ministry/Department उसे CCS (Pension) Rules, 2021 के तहत consider करेगा, भले appointment बाद में हुई हो।
Army और Armed Forces families के लिए यहां एक महत्वपूर्ण distinction है: serving Armed Forces personnel की अपनी military pension पर यह CAT judgment लागू नहीं है। NPS को 1 January 2004 से Central Government recruits के लिए लागू किया गया था, लेकिन Armed Forces personnel उससे excluded रहे और defence pensions अलग framework में चलते हैं। दूसरी तरफ, eligible Armed Forces personnel के dependants को civilian Group ‘C’ posts पर compassionate appointment देने का Central Government framework मौजूद है। ऐसे पुराने civilian compassionate-appointment cases में यह 2026 OPS clarification relevant हो सकती है।
Vineet Kumar OPS case में exactly क्या हुआ?
Vineet Kumar के पिता Delhi Police में ASI (Executive) थे और उनकी 28 October 2003 को service के दौरान मृत्यु हुई। Vineet Kumar ने compassionate appointment के लिए 14 November 2003 को application दी और 25 November 2003 को physical measurement भी हुआ। लेकिन appointment order 18 October 2004 को आया और उन्होंने 21 October 2004 को Constable (Executive) के रूप में join किया।
Joining 1 January 2004 के बाद होने के कारण उन्हें NPS में रखा गया।
उन्होंने 2020 में OPS coverage मांगी, लेकिन उनका request reject कर दिया गया। बाद में 2023 में Government ने कुछ post-2003 appointees को one-time OPS option दिया, लेकिन Vineet Kumar ने निर्धारित समय में वह option exercise नहीं किया।
CAT ने इस missed option को अकेले relief deny करने के लिए पर्याप्त नहीं माना क्योंकि applicant पहले से OPS claim कर रहा था और respondents यह establish नहीं कर सके कि relevant option opportunity उसे personally communicate की गई थी। Tribunal ने department को option obtain करके applicable instructions के तहत OPS benefit देने की exercise 12 weeks में पूरी करने का direction दिया।
22 June 2026 का नया Government rule इतना important क्यों है?
यह इस पूरी story का सबसे महत्वपूर्ण policy development है।
DoP&PW के O.M. No. 57/05/2021-P&PW(B)/Compassionate/10593 में Government ने माना कि compassionate appointment सामान्य recruitment से अलग है क्योंकि इसमें advertisement या recruitment notification जैसी कोई obvious cut-off event नहीं होती।
Government ने इसलिए decide किया:
Compassionate appointment application की date ही crucial date होगी, provided candidate application submit करते समय appointment consideration के लिए eligible था।
OM आगे स्पष्ट करता है कि:
31 December 2003 या उससे पहले apply करने वाला eligible family member CCS (Pension) Rules, 2021 के तहत consideration पा सकता है।
यह direction सभी Central Government Ministries/Departments के लिए जारी किया गया है।
2023 OPS rule और 2026 compassionate appointment rule में क्या फर्क है?
3 March 2023 की Government instructions उन employees के लिए थीं जिनकी recruitment वाली post/vacancy 22 December 2003 या उससे पहले advertised/notified हुई थी, लेकिन appointment 1 January 2004 या उसके बाद हुई। ऐसे employees को certain conditions के साथ OPS option दिया गया था।
Compassionate appointment में problem यह थी कि यहां regular recruitment advertisement होता ही नहीं।
इसी gap को 22 June 2026 rule ने address किया।

क्या यह judgment Army personnel को OPS देता है?
नहीं।
यह distinction सबसे पहले साफ होना चाहिए।
Vineet Kumar का मामला Delhi Police में civilian employment से संबंधित है। CAT ने Indian Army, Navy या Air Force के serving personnel की pension पर कोई फैसला नहीं दिया।
Central Government NPS को 1 January 2004 से नए Central Government recruits के लिए mandatory किया गया था, लेकिन Armed Forces personnel को इससे बाहर रखा गया था। Department of Financial Services और PFRDA की current information भी यही position बताती है।
इसलिए कोई serving Army soldier, JCO या officer इस judgment के आधार पर यह नहीं कह सकता कि:
“CAT ने मुझे NPS से OPS में shift होने का नया अधिकार दिया है।”
उनकी military pension अलग defence pension framework में आती है।
फिर Army और Defence families के लिए connection कहां बनता है?
Connection civilian compassionate appointment से आता है।
Ministry of Defence ने Parliament में बताया है कि DoPT की compassionate appointment instructions के तहत Defence Civilian employee और Armed Forces Personnel दोनों के eligible dependent family members को Group ‘C’ direct-recruitment posts पर compassionate appointment के लिए consider किया जा सकता है।
यानी उदाहरण के लिए:
- किसी Army/Armed Forces personnel की death के बाद eligible dependent ने civilian compassionate appointment के लिए apply किया;
- application 31 December 2003 या उससे पहले दी;
- applicant उस date पर eligible था;
- लेकिन administrative processing के कारण actual civilian appointment 2004 या बाद में हुई;
- employee को उस civilian post पर NPS में रखा गया;
तो 22 June 2026 की DoP&PW clarification उसके pension coverage के लिए potentially relevant हो सकती है।
लेकिन final eligibility concerned service records, post, appointment authority और applicable pension rules देखकर ही तय होगी।
Defence Civilian employees के लिए यह rule कैसे relevant हो सकता है?
CCS pension framework में civilian Government servants in the Defence Services expressly recognised category हैं। Government pension rules Army/Navy/Air Force personnel की military pension और Ministry of Defence के civilian employees को एक ही category नहीं मानते।
इसलिए Ministry of Defence establishments में ऐसे civilian compassionate appointees जिनका application pre-2004 था लेकिन joining बाद में हुई, उन्हें अपना record जरूर check करना चाहिए।
लेकिन “Defence establishment में काम करना” alone OPS eligibility नहीं बनाता।
Key test फिर वही रहेगा:
application date + eligibility on that date + nature of civilian appointment + applicable pension rules.
क्या Armed Forces dependants को compassionate appointment automatically मिलता है?
नहीं।
Compassionate appointment कोई automatic inheritance of Government job नहीं है।
Government framework के तहत appointment prescribed conditions, financial hardship assessment, eligibility और available Group ‘C’ direct-recruitment vacancies के subject में होती है। Official Government material के अनुसार compassionate appointment के लिए ceiling direct-recruitment Group ‘C’ vacancies के निर्धारित quota से जुड़ी है।
इसलिए:
Parent served in Army → dependent automatically gets Government job
यह सही interpretation नहीं है।
और उसी तरह:
Compassionate appointment मिला → automatically OPS
यह भी सही नहीं है।
किन Army/Defence family cases को अपना record check करना चाहिए?
सबसे ज्यादा relevant category वह हो सकती है जहां:
- compassionate appointment civilian Government post पर हुई हो;
- original application 31 December 2003 या उससे पहले submit हुई हो;
- applicant application date पर eligible रहा हो;
- appointment/joining 1 January 2004 या उसके बाद हुई हो;
- employee को NPS में cover किया गया हो।
कौन-से documents सबसे पहले निकालने चाहिए?
Similar case में सबसे महत्वपूर्ण document appointment order नहीं, original application record बन सकता है।
Affected employee को ideally यह documents collect करने चाहिए:
- compassionate appointment application;
- application receipt/date proof;
- deceased employee या Armed Forces personnel का service/death record;
- proof of applicant’s eligibility on application date;
- departmental compassionate appointment proceedings;
- appointment order;
- actual joining report;
- NPS/PRAN record;
- earlier OPS representations, यदि कोई हों;
- department का rejection order;
- 2023 OPS-option communication;
- evidence कि option personally communicated हुआ था या नहीं;
- DoP&PW OM dated 22 June 2026.
Application date की documentary proof particularly important है क्योंकि Government ने उसी को crucial date बनाया है।
क्या 2003 में Army personnel की death होना अपने-आप OPS eligibility देता है?
नहीं।
Cut-off death की date नहीं है।
22 June 2026 OM specifically compassionate appointment application date को crucial मानता है।
इसलिए:
Death: December 2003
Application: February 2004
और
Death: October 2003
Application: November 2003
दोनों cases को एक जैसा treat करना उचित नहीं होगा।
Current OM के लिए critical question है:
Application कब submit हुई और applicant उस date पर eligible था या नहीं?
क्या 31 August 2023 का missed OPS option अब सभी के लिए irrelevant हो गया है?
नहीं।
Vineet Kumar judgment 2023 deadline को universally cancel नहीं करता।
उनके case में special factual circumstances थीं:
- applicant 2020 से OPS मांग रहा था;
- department उसके पुराने claim से aware था;
- वह बाद में option exercise नहीं कर पाया;
- CAT के सामने respondents personal communication establish नहीं कर सके।
इसलिए किसी दूसरे employee को यह साबित करना पड़ सकता है कि उसका factual position भी legally comparable है।
यदि employee को option clearly communicate किया गया था और उसने consciously exercise नहीं किया, तो Vineet Kumar case का outcome automatically reproduce होगा—ऐसा कहना अभी सही नहीं होगा।
CAT order और Government OM में सबसे बड़ा फर्क क्या है?
दोनों को अलग रखना जरूरी है।
22 June 2026 DoP&PW OM
→ Government-wide policy clarification है।
→ Compassionate appointment application date को crucial date बनाता है।
Vineet Kumar CAT judgment
→ Specific petitioner के missed option और OPS claim को resolve करता है।
→ Delhi Police को option लेकर benefit process करने की direction देता है।
यही distinction Army/Defence families के लिए भी महत्वपूर्ण है।
उनकी possible eligibility CAT judgment से सीधे नहीं, बल्कि broader Government rule और अपने individual service facts से आएगी।
What is confirmed?
- DoP&PW ने 22 June 2026 को compassionate appointments के लिए application date को crucial date बनाया है।
- Application 31 December 2003 या उससे पहले होनी चाहिए और applicant उस date पर eligible होना चाहिए।
- CAT records O.A. No. 1721/2025 को Vineet Kumar vs Delhi Police के Old Pension Scheme matter के रूप में confirm करते हैं।
- Vineet Kumar ने 14 November 2003 को apply किया और October 2004 में join किया।
- Armed Forces personnel स्वयं Central Government NPS framework से excluded रहे हैं।
- Armed Forces personnel के eligible dependants के लिए civilian Group ‘C’ compassionate appointment framework मौजूद है।
क्या automatically assume नहीं करना चाहिए?
- CAT ने serving Army personnel को OPS दिया है।
- हर Army widow/dependent को इस judgment से pension benefit मिलेगा।
- 2003 में death होना अपने-आप OPS entitlement बनाता है।
- 1 January 2004 के बाद submit हुई हर compassionate application cover होगी।
- 2023 option deadline सभी employees के लिए खत्म हो गई है।
- Armed Forces dependant की हर civilian appointment CCS pension framework में identical तरीके से covered होगी।
- Vineet Kumar judgment सभी cases में automatic precedent-based payment order है।
What Army and Defence families should know?
Vineet Kumar judgment Army pension case नहीं है। इसलिए इसे “Army personnel को OPS मिल गई” के रूप में present करना गलत होगा।
इसके बावजूद 22 June 2026 का Government decision defence audience के लिए relevant हो सकता है क्योंकि Armed Forces personnel और Defence Civilian employees के eligible dependants के लिए civilian compassionate appointment का official framework मौजूद है। जहां ऐसी application 31 December 2003 या उससे पहले दी गई थी और actual civilian appointment post-2003 हुई, वहां pension coverage दोबारा examine करने का आधार बन सकता है।
Affected families के लिए सबसे जरूरी कदम court case copy करना नहीं, बल्कि पहले original application date, eligibility, appointment category, NPS record और applicable pension rules verify करना है।
